General Terms and Conditions of Sale

Application of the AVB

These General Terms and Conditions of Sale (AVB) apply to all sales transactions of the August Laube Antiquarian, including all sales via the August Laube Online Shop, https://augustlaube.ch/shop/ (online shop). The AVBs are enclosed with each purchase or are to be accepted below by confirming with the click of a mouse before each order.

These AVBs are modified or otherwise modified from time to time. The version of the AVBs in force at the time of the respective order is decisive, which is of course considered to be firmly agreed for the order made.

Validity of the offer

The offer in the online shop is valid as long as it is visible in the online shop. However, the offer is always subject to change, especially since the property for sale may have already been ordered elsewhere. Price and offer changes are possible at any time.

Prices & Terms of Payment

The prices are in Swiss francs and are net prices, i.e. excluding VAT. The applicable VAT is shown at the time of invoicing. Payments must be made in advance We reserve the ownership of the sold property until all payments from the contract have been received. The objects offered for sale, e.B. graphics, drawings, books, will be sent immediately to the specified address after the full transfer to the account below has been credited. Any transfer costs are to be borne by the buyer.

Offer & Acceptance

The presentation of the offered objects in the online shop is not a legally binding application, but a non-binding online catalogue or a non-binding invitation to the visitors of the online shop to purchase the offered objects by online order.

An order is considered an offer to conclude a purchase contract.

After the order has been submitted, the customer will receive a confirmation by e-mail that the order has been received. Subsequently, an individually dispatched confirmation of the order will be made. Only by this confirmation, but at the latest with the dispatch of the object to the specified address, the purchase contract is deemed to have been concluded and has binding effect on both parties.

The antiquarian August Laube is free to refuse orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded immediately. Further claims are excluded.

Liability & Guarantee

The description of the objects offered for sale is made to the best of our knowledge and belief. For any errors, especially in the attribution of the objects, the August Laube Antiquarian is liable as a total of up to a maximum of the amount of the purchase price including shipping costs.

All objects, unless otherwise stated, are in good condition according to their age. Insignificant defects such as name registrations, pencil strokes, small traces of use or similar are not always specifically mentioned, but are taken into account in the indicated price.

Damage to the transport route must be notified within two (2) days. The liability of the August Laube Antiquarian shall expire no later than one month after receipt. The customer must carefully and carefully inspect the purchased object immediately upon receipt. A loss of value, which results in the use of the object beyond a mere inspection of the sent object, which means that the object can no longer be sold in its original state, shall be borne by the purchaser.

Privacy

Customer data is treated confidentially exclusively in connection with the handling of the sale of the offered objects and the maintenance of a customer file. Customer data or parts thereof, with the exception of the company making the shipment, will not be passed on to or otherwise made available to third parties. Their processing is carried out in accordance with the applicable standards of the Swiss Federal Act on Data Protection (DSG). With an order it is accepted that the August Laube Antiquarian may be sent to the customer until revocation a z.B. new receipt list in the form of a newsletter to the specified e-mail address or postal address.

Shipment, Insurance & Redemption

No dispatches will be made on Sundays and official national or cantonal holidays.

The customer can request delivery to an alternative address as long as the shipment can be received there in person and the receipt can be confirmed by this person.

The customer assumes responsibility (cost and danger) for the shipped objects, even if they have not been received directly by him/her. At the request of the customer, the delivery can be insured. The insurance costs shall be borne by the customer.

In the event of a well-founded complaint in accordance with Clause 5, Liability & Guarantee, the ordered object can be returned after consultation within one month. In the case of a return, a copy of the invoice must be enclosed and the same method of dispatch must be used and, if the shipment was insured, take out insurance in its own form.

Shipping Costs & Customs

Shipping costs depend on the weight, the mass and also the value of the orders. Shipping costs are listed as an additional line on the invoice.

Imports of goods to countries outside Switzerland may incur import duties that the customer has to bear. These vary in different customs areas. The customer is responsible for the proper collection of the necessary duties and fees.

Severability Clause & Written

In the event that any portion of these AVBs is declared invalid or unenforceable by a court, the validity or enforceability of the remaining regulations or parts thereof shall not be affected. An invalid or unenforceable provision shall be amended or construed as to best achieve the objectives of the Regulation under applicable law.

Oral agreements do not apply if they have not been specified in writing and have been demonstrably agreed by signature or e-mail with confirmation e-mail.

Place of performance, law & place of jurisdiction

Place of performance is Zurich, Switzerland. Material Swiss law applies to the legal relationship between the August Laube Antiquariat and the customer, excluding conflict-of-law norms of private international law.

The exclusive place of jurisdiction is Zurich, Switzerland.
